By engaging with our online platform, purchasing products, or using any of our services including fresh flower arrangements, bespoke bouquets, corporate floral subscriptions, plant sales, gift delivery, or floral workshops, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.
2. Services Provided by Windswept Bloom
Windswept Bloom offers a range of floral design and delivery services. These include, but are not limited to:
- Fresh flower arrangements for various occasions.
- Custom bespoke bouquets for events and special requests.
- Corporate floral subscriptions for businesses.
- Sale of various plants.
- Gift delivery services alongside floral products.
- Floral workshops and educational sessions.
We strive to ensure all information and images on our site are accurate. However, due to the natural variations of fresh flowers and plants, actual products may vary slightly from those shown. Substitutions may be made if specific blooms are unavailable, always ensuring the aesthetic and value of the arrangement are maintained.
3. Online Ordering and Payment
Our online platform facilitates the browsing and ordering of our floral products and services. When placing an order, you agree to provide complete and accurate information. All prices are listed in New Zealand Dollars (NZD) and are subject to change without prior notice. Payment must be made in full at the time of ordering through the accepted payment methods displayed on our site.
- Orders are subject to availability and confirmation upon receipt of payment.
- We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product descriptions, or issues identified with your payment.
4. Delivery Information
Windswept Bloom offers delivery services within the specified delivery zones. It is your responsibility to provide accurate delivery details, including recipient name, address, and contact number. We are not responsible for delays or non-delivery resulting from incorrect or incomplete information provided by you.
- Delivery times are estimates and cannot be guaranteed, especially during peak seasons or unforeseen circumstances.
- If the recipient is not available at the time of delivery, we will attempt to leave the flowers in a safe, shaded spot, or with a neighbour, if deemed appropriate. If no safe location is available, re-delivery may incur an additional charge, or the item may need to be collected from our premises.
5. Cancellations and Refunds
Cancellations or modifications to orders must be requested within a reasonable timeframe prior to the scheduled delivery or workshop date. Specific policies apply based on the service:
- Fresh Flower Orders: Cancellations must be received at least 24 hours prior to the requested delivery date for a full refund.
- Bespoke & Event Floral: Due to the custom nature, specific cancellation terms will be detailed in your individual quote or agreement.
- Workshops: Cancellation policies for workshops will be outlined at the time of booking. Generally, a minimum notice period is required for a refund or transfer.
- Refunds: Refunds will be processed to the original payment method. We do not offer refunds for products that have been delivered and are not deemed faulty or damaged upon arrival.
If you are dissatisfied with your order, please contact us within 24 hours of receipt with details and photographic evidence so we can assess and resolve the issue.
6. Intellectual Property
All content on our online platform, including images, designs, text, logos, and service descriptions, are the intellectual property of Windswept Bloom or its content suppliers and are protected by New Zealand and international copyright laws. You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission.
7. Limitation of Liability
Windswept Bloom will not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use our services; (ii) any conduct or content of any third party on our services; (iii) any content obtained from our services; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
8. Governing Law
These Terms and Conditions shall be governed and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Auckland, New Zealand, for the resolution of any disputes.
9. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
